Real estate agencies have never had AML obligations before. From July 1, 2026, they do. And AUSTRAC has made clear that enforcement will apply equally to Tranche 2 entities.

The consequences of non-compliance include civil penalties of up to 100,000 penalty units for a body corporate (currently approximately $33 million) and 20,000 penalty units for individuals (currently approximately $6.6 million), enforceable undertakings, infringement notices, remedial directions, and public enforcement action. Penalty unit values are subject to indexation.

AUSTRAC's own summary states that criminal penalties apply for certain offences. The cost of compliance is a fraction of the cost of getting it wrong.

If your agency brokers the sale, purchase, or transfer of real estate, yes. AUSTRAC's new obligations apply to real estate agents, buyer's agents, and property developers from 1 July 2026. Use AUSTRAC's online tool to check if your specific services are captured.
